Fairview is a candidate assessment and interview monitoring platform that provides data and insights to companies conducting interviews. The Software monitors various activities during interview processes and provides analytics to help companies make informed hiring decisions.
3. Data Collection and Monitoring
Fairview monitors and collects the following data during interview sessions:
3.1 Network Monitoring
- API network calls related to AI services and usage
- Internet connectivity and network activity patterns
- Operating system logs to detect API usage and system-level activity
3.2 Application Monitoring
- Usage of AI applications and tools on the candidate's computer
- Application switching and multitasking behavior
- Installation and presence of AI-related software
3.3 System Activity Monitoring
- Copy and paste actions (frequency and timing only - NOT content)
- VPN usage detection and reporting
- General system interaction patterns
3.4 What We Do NOT Monitor
- The actual content of copied or pasted text
- Personal files or documents unrelated to the interview
- Communications outside the interview context
4. Data Sharing and Retention
4.1 Company Reporting
All monitored data and insights are shared with the company conducting the interview for assessment purposes.
4.2 Cross-Company Data Sharing
Candidate data and insights may be shared with other companies that use the Fairview platform. By using this service, you consent to this data sharing practice.
4.3 Data Retention
We retain candidate data and may use it to improve our analytics and provide insights across multiple assessments and companies.
5. User Categories and Responsibilities
5.1 For Interview Candidates
By using Fairview during an interview process, you acknowledge and consent to:
- Comprehensive monitoring of your computer activity during the session
- Sharing of your assessment data with the interviewing company
- Potential sharing of your data with other companies using our platform
- Storage and retention of your assessment data
5.2 For Companies/Employers
Companies using Fairview agree to:
- Obtain proper consent from candidates before monitoring
- Comply with all applicable employment and privacy laws
- Use the data solely for legitimate hiring assessment purposes
- Inform candidates about the monitoring and data sharing practices
6. Limitations of Service
6.1 Assessment Only
Fairview provides data and insights only. We do not make hiring recommendations or decisions. All hiring decisions remain solely with the employer.
6.2 Data Interpretation
The insights provided are based on behavioral patterns and technical monitoring. Users should interpret results within appropriate context and in compliance with applicable laws.
7. Privacy and Consent
7.1 Candidate Consent
Candidates must provide explicit consent before participating in a Fairview-monitored interview session.
7.2 Legal Compliance
Use of Fairview must comply with all applicable laws, including but not limited to:
- Employment discrimination laws
- Privacy and data protection regulations
- Computer monitoring and surveillance laws
- Consent requirements in your jurisdiction
8. Prohibited Uses
You may not use Fairview to:
- Monitor individuals without their knowledge and explicit consent
- Discriminate based on protected characteristics
- Violate any applicable privacy or employment laws
- Use the data for purposes other than legitimate hiring assessments
- Reverse engineer or attempt to circumvent the monitoring capabilities
9. Disclaimers and Limitations
9.1 Service Availability
Fairview is provided "as is" without guarantees of uptime, accuracy, or completeness.
9.2 Assessment Accuracy
While we strive for accurate monitoring, technical limitations may affect data collection. Users should not rely solely on Fairview data for hiring decisions.
9.3 Legal Compliance
Users are responsible for ensuring their use of Fairview complies with all applicable laws in their jurisdiction.
10. Limitation of Liability
ALTESINO LABS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE USE OF FAIRVIEW, INCLUDING BUT NOT LIMITED TO HIRING DECISIONS, PRIVACY VIOLATIONS, OR LEGAL VIOLATIONS BY USERS.
11. Data Security
While we implement reasonable security measures to protect collected data, users acknowledge the inherent risks in data collection and transmission over the internet.
12. Intellectual Property
All rights, title, and interest in Fairview, including all software, algorithms, and methodologies, remain the property of Altesino Labs, LLC.
13. Termination
13.1 Termination by Users
You may stop using Fairview at any time, but previously collected data may be retained according to our data retention policies.
13.2 Termination by Altesino Labs
We reserve the right to terminate access to Fairview for violations of these Terms or for any other reason.
14. Updates and Modifications
We reserve the right to update these Terms and the Fairview service at any time. Continued use constitutes acceptance of any changes.
15. International Users
Users outside the United States are responsible for compliance with their local laws regarding employment monitoring, data protection, and privacy.
